1. Acceptance of Terms

By accessing and using the services provided by IT Solutions Kenya ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

IT Solutions Kenya provides a range of IT services including but not limited to:

• Software development (web, mobile, and enterprise applications)
• Cybersecurity consulting and implementation
• IT consulting and strategy
• Graphic design and branding
• Network solutions and infrastructure
• Technical support and maintenance

3. User Responsibilities

As a user of our services, you agree to:

• Provide accurate and complete information when requested
• Maintain the confidentiality of any account credentials
• Use our services only for lawful purposes
• Not interfere with or disrupt our services or servers
• Not attempt to gain unauthorized access to any part of our systems
• Comply with all applicable laws and regulations

4. Intellectual Property

Unless otherwise agreed in writing, all intellectual property rights in deliverables created by IT Solutions Kenya shall transfer to the client upon full payment. We retain the right to use generic, non-proprietary components and methodologies developed during the engagement.

5. Payment Terms

Payment terms are specified in individual project agreements. Generally:

• A deposit may be required before project commencement
• Invoices are due within 30 days of issuance unless otherwise agreed
• Late payments may incur interest charges
• We reserve the right to suspend services for non-payment

6. Limitation of Liability

To the maximum extent permitted by law, IT Solutions Kenya shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to these terms or our services.

7. Warranties and Disclaimers

We warrant that our services will be performed with reasonable skill and care. However, we do not warrant that our services will be error-free or uninterrupted. All other warranties, express or implied, are excluded to the maximum extent permitted by law.

8. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or confidential information shared during the course of the engagement. This obligation survives the termination of our business relationship.

9. Termination

Either party may terminate the engagement with written notice as specified in individual project agreements. Upon termination, the client shall pay for all services rendered up to the termination date.

10. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of the modified terms.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
